Erklärung der Teilnehmer
Mit meiner Teilnahme am Altöttinger Halbmarathon oder einer der in diesem Rahmen angebotenen Veranstaltungen, erkenne ich den Haftungsausschluss des Veranstalters für Personen- oder Sachschäden jeder Art an.
Mir ist bekannt, dass ich disqualifiziert werde, wenn ich den Kurs der offiziell vermessenen Strecke verlasse, abkürze oder mich technischer Hilfsmittel (Auto, Fahrrad, etc.) bediene.
Ich erkenne mit meiner Anmeldung an, dass ich die Teilnahmegebühr entrichten werde und keinen Anspruch auf Rückerstattung habe
Ich werde weder gegen die Veranstalter, deren Helfer oder Sponsoren der Veranstaltung, noch gegen die Stadt Altötting oder deren Vertreter Ansprüche erheben, sollten mir durch meine Teilnahme am Lauf oder während des Rahmenprogrammes Schäden oder Verletzungen entstehen.
Dieser Haftungsauschluss gilt auch für meine Begleitpersonen oder Betreuer.
Ich erkläre, dass ich medizinisch gesund bin und einen ausreichenden Trainingszustand besitze. Ich bin damit einverstanden, dass ich aus dem Rennen genommen werde, wenn ich Gefahr laufe, mich gesundheitlich zu schädigen. Beachten Sie unseren Fragenkatalog!
Ich bestätige ausdrücklich die Richtigkeit aller von mir angegebenen Daten und versichere, meine Startnummer an keine andere Person weiterzugeben. Des Weiteren ist mir bekannt, dass ich disqualifiziert werde, wenn ich die offizielle Startnummer in irgendeiner Weise verändere, insbesondere den Werbedruck unsichtbar oder unkenntlich mache oder wenn ich mich von Personen, die nicht am Rennen teilnehmen, begleiten lasse.
Die Startnummer ist nicht übertragbar, muss in Brusthöhe getragen werden und darf nicht verändert werden.
Wer ohne Startnummer oder ohne Chip läuft, wird disqualifiziert !!
Ich erkläre mich außerdem damit einverstanden, dass in der Meldung angegebene personenbezogene Daten gespeichert und die im Zusammenhang mit der Veranstaltung gemachten Fotos, Filmaufnahmen und Interviews in Rundfunk, Fernsehen, Werbung, Büchern, fotomechanischen Vervielfältigungen, auf unserer Internetseite, sowie weitere Werbezwecke für die Veranstaltung ohne Vergütungsanspruch zeitlich unbegrenzt veröffentlicht werden können.
Fotoaufnahmen
Wir werden durch Foto- und Videoaufnahmen die wir während der Veranstaltung erstellen nicht in Ihre Datenschutzsphäre eindringen. Die durch unseren beauftragten Fotografen erstellten Fotos werden ohne Interesse an Ihren personenbezogenen Daten erstellt und verarbeitet. Somit wird kein Bezug zu Ihnen hergestellt.
Dieser unnötige Aufwand der Identifizierung Ihrer Person ist nicht gerechtfertigt und würde einen tieferen Eingriff in Ihr Persönlichkeitsrecht darstellen, als die Informationsübermittlung. Somit handeln wir im Sinne des DSGVO.
Weder Zuschauer, Betreuer oder Gäste der Veranstaltungen dürfen Fotos für kommerzielle Zwecke verwenden.
Die Fotogenehmigung zum Vertrieb unserer Wettkampfbilder hat unser Bilderdienst.
Hier ist die rechtliche Situation durch die DSGVO abweichend zu obig genannter, deshalb bitte beachten!
EINVERSTÄNDNISERKLÄRUNG
Der Teilnehmer erklärt sich damit einverstanden, dass seine personenbezogenen Daten, nämlich Familienname, Vorname, Adresse, Emailadresse, die ihm zugeteilte Startnummer, an unseren Fotodienst weitergegeben werden zu dem Zwecke, dass dieser selbständige Fotograf, Fotos der Teilnehmer der Veranstaltung macht, und den Teilnehmern zum Verkauf anbietet.
Der Teilnehmer erteilt daher hiermit seine ausdrückliche Einwilligung, dass der selbständige Fotodienst, Fotos von ihm bei der Veranstaltung macht, ihn allenfalls persönlich mit dem Angebot des Verkaufs der von ihm gemachten Fotos kontaktiert, jedenfalls aber die von ihm gemachten Aufnahmen auf seiner Homepage zur Ansicht veröffentlicht, um kaufinteressierten Teilnehmern die Auswahl zum Erwerb über den auf dieser Homepage geführten Webshop zu ermöglichen.
Die Datenschutzerklärung der selbständigen Fotodienst ist durch die Veröffentlichung somit zur Kenntnis genommen.
Wir untersagen jegliche weitere Vermarktung durch Fotografen und Bilderdienste die keine vertragliche Vereinbarung mit dem Veranstalter getroffen haben!
Im START-und ZIELBEREICH dürfen sich nur durch den Veranstalter akkreditierte Fotografen aufhalten!
Desweiteren übernimmt der Veranstalter keine Haftung für Schäden die durch höhere Gewalt verursacht werden. Bei Absage des Rennens auf Grund höherer Gewalt oder Anordnung öffentlicher Behörden sowie zum Schutz des Teilnehmers werden keine Kosten (z.B. Meldegebühr) erstattet.
Wir müssen Sie auch auf das bestehende Rauchverbot im Wald hinweisen.
Die Bezahlung der Organisationsgebühr erfolgt durch die Erteilung einer einmaligen Einzugsermächtigung. Fehlerhafte Angaben und dadurch entstehende Verwaltungsgebühren gehen zu Lasten des Teilnehmers.
Preise, oder Urkunden werden nicht nachgeschickt!

1. scope and organizer
1.1 The following terms and conditions of participation apply to the event 33. Halbmarathon Altötting (hereinafter referred to as "event").
1.2 The organizer of the respective event is TopSport (hereinafter referred to as "organizer", "we" or "us").
1.3 The Terms and Conditions of Participation apply in the version valid at the time of registration and form part of the contract between the Organizer and the participants.
2. Registration, conclusion of contract, participation fees and services
2.1 The subject matter of the contract is the organization of the respective event in accordance with the published announcement.
2.2 Registration shall take place exclusively via the officially advertised registration systems up to the respective stated registration deadline and only as long as the maximum number of participants has not been reached.
2.3 The contract shall come into effect upon receipt of the registration confirmation by email.
2.4 If the maximum number of participants is reached before the registration deadline, the registration shall be closed prematurely. There is no entitlement to participation.
2.5 All information relevant to the event will be sent by email to the address provided during registration in good time before the event.
2.6 Registrations by minors or persons with limited legal capacity may only be made by their legal representatives. A consent and release from liability signed by the legal representative must be submitted before the start of the event. Participation or collection of event documents is only possible in the presence of a legal representative or upon presentation of a corresponding power of attorney.
2.7 The participation fee shown on the registration form shall apply. This fee and fees for additional services must be paid immediately after registration by SEPA direct debit or credit card.
2.8 Withdrawal by the participant - for whatever reason - or a no-show shall not entitle the participant to a refund of the participation fee or other fees. The same applies in the event of exclusion or disqualification.
2.9 Transfer of registration to third parties is excluded, unless otherwise stipulated in the invitation to tender. The collection of event documents by third parties is only possible with written authorization and presentation of the registration confirmation.
2.10 Cancellation of the event (force majeure): If the event cannot be held for reasons of force majeure or official order for which the organizer is not responsible (e.g. severe weather, natural disasters, pandemics, terror, war), the starting or participation place can be transferred to a subsequent event, provided there is capacity. Alternatively, the participation fee will be refunded, but not the stated organizational and preparation costs.
2.11 Cancellation or modification of the event: If the event is canceled prematurely for the reasons stated in 2.10 or its implementation is changed (e.g. change of route, schedule adjustment, format change), there is no entitlement to a refund or compensation.
2.12 If the number of participants has to be reduced for official or safety-related reasons, admission will be granted according to the time of receipt of the registration. Affected participants will be informed immediately.
3. Eligibility, rules and health requirements
3.1 Any person who meets the requirements specified in the announcement (e.g. minimum age, qualifications) and is not subject to a participation or starting ban is eligible to participate.
3.2 By registering, the participant acknowledges the applicable event rules, implementation regulations and any relevant association or sports regulations, insofar as these are stated in the invitation to tender.
3.3 Participation is strictly personal. Passing on start numbers, participant IDs or access data will result in exclusion and possibly further sanctions.
3.4 The participant declares that he/she is in good health to take part in the event. In the event of health risks or signs of indisposition, participation must be refrained from or participation must be discontinued immediately.
3.5 In the event of known illnesses or health restrictions that require special medical care, participation is at the participant's own risk, unless expressly prohibited by the organizer in advance.
3.6 The participant is responsible for the proper, functional and safe condition of the equipment, materials or aids used.
3.7 Where provided, start numbers, participant identification or proof of access must be worn or used visibly, unchanged and in accordance with the event rules. Participation or classification may be excluded without valid identification.
3.8 Shortening routes, using unauthorized aids, unauthorized support from third parties and violations of applicable fair play, anti-doping or participation regulations are prohibited and will result in disqualification.
3.9 The instructions of the organizer, its employees and any auxiliary persons employed must be followed at all times.
3.10 On public traffic areas, the relevant legal regulations, in particular the Road Traffic Regulations (StVO), shall apply - irrespective of route safety or permits.
4. Disqualification and ban on participation
4.1 Violations of these Conditions of Participation, of event rules or of the organizer's instructions may result in exclusion or disqualification, in particular in the following cases
- unsportsmanlike or grossly disorderly conduct
- violations of rules or participation
- doping or manipulation violations
- unauthorized assistance
- passing on or manipulation of start numbers or participation entitlements
- shortening or unauthorized alteration of the route
- disregard of the organizer's instructions
4.2 The organizer is entitled to impose a temporary or permanent ban on participation in future events in the event of serious or repeated violations.
4.3 Results and rankings will be published. Objections must be made in text form within 24 hours of publication.
5. Image and sound recordings
5.1 Photographs, videos and sound recordings will be made as part of the event.
5.2 The participant agrees that these recordings may be used for editorial, documentary and commercial purposes without restriction in terms of time, space and content.
5.3 The legal basis is Art. 6 para. 1 lit. f GDPR. In the case of minors, the consent of the legal representative is required.
6. Liability
6.1 The organizer is liable without limitation for intent and gross negligence as well as for injury to life, body or health.
6.2 In the event of a slightly negligent breach of essential contractual obligations, liability is limited to the foreseeable damage typical for the contract.
6.3 No liability is assumed for items, equipment or valuables brought along, unless there is intent or gross negligence.
7. Right of withdrawal
A right of withdrawal does not exist in accordance with § 312g para. 2 no. 9 BGB.
8. Data protection
8.1 The processing of personal data is carried out for the execution of the contract in accordance with Art. 6 para. 1 lit. b GDPR.
8.2 Result lists and participant lists may - if relevant for the event - contain and be published in particular surname, first name, year of birth, gender, club/team, start number, placings or results.
8.3 Contact details will only be passed on to third parties with express consent.

9. Final provisions
9.1 The law of the Federal Republic of Germany shall apply.
9.2 Should individual provisions be or become invalid, the validity of the remaining provisions shall remain unaffected.
