Teilnahme-Bedingungen
1. Anmeldung und Reservierungsbestätigung
1.1 Mit der Anmeldung bietet der/die Erziehungsberechtigte dem Bayerischen Triathlon-Verband e.V. (BTV) den Abschluss eines Teilnahme-Vertrages verbindlich an. Dies erfolgt online mit dem offiziellen Anmeldeformular.
1.2 Der Teilnahme-Vertrag kommt mit der Annahme durch den BTV zustande. Voraussetzung für die Annahme ist der Eingang der Anmeldung beim BTV. Über die Annahme der Anmeldung unterrichtet der BTV den/die Erziehungsberechtigte/n durch die Übersendung einer verbindlichen Teilnahmezusage per E-Mail.
1.3 Der/ Die Erziehungsberechtigte ist der Vertragspartner des BTV.
1.4 Mit der Anmeldung werden vom Erziehungsberechtigten die Teilnahme-Bedingungen des Camps verbindlich anerkannt.
1.6 Mit der Buchung der/die Erziehungsberechtigte mit dem BTV einen Vertrag ab, der dem Kind einen Platz im gewählten Camp sichert.
Im Falle einer Stornierung der Buchung oder eines Nichterscheinens am Camp behält sich der BTV vor, gemäß der aktuell geltenden AGBs eine Stornorechnung zu stellen.
2. Teilnahmevoraussetzungen
2.1 Die für das jeweilige Angebot in der Ausschreibung gennannten Teilnahmevoraussetzungen werden mit der Anmeldung anerkannt.
2.2 Die in der Ausschreibung genannten speziellen Teilnahmevoraussetzungen sind verpflichtend. Werden diese Teilnahmevoraussetzungen nicht erfüllt, kann der Teilnehmer vorher oder auch zu Beginn während des Lehrgangs von der Teilnahme ausgeschlossen werden. Ein Anspruch auf Rückerstattung bereits geleisteter Zahlungen besteht in diesem Fall nicht.
3. Kosten
3.1 Die Gebühren ergeben sich aus der jeweiligen Ausschreibungen. Über die jeweiligen Teilnahmegebühren erhält der Teilnehmer eine Rechnung.
3.2 Kosten für Nebenleistungen, die nicht in der Campgebühr enthalten sind, zahlt der Teilnehmer gesondert.
4. Zahlung
4.1 Die Zahlung erfolgt im Zuge der Anmeldung. Ein Anspruch auf Rückerstattung bereits geleisteter Zahlungen besteht nicht.
4.2 Folgende Zahlungsmöglichkeiten bietet der BTV:
Zahlung per Kreditkarte
Zahlung per Lastschrift
4.3 Bei Rücklastschriften nicht erfolgreicher Bankeinzüge werden angefallene Bankgebühren dem Zahlenden berechnet.
5. Rücktritt
5.1 Der Vertragsnehmer kann jederzeit vor Campbeginn zurücktreten. Dies hat im Interesse des Vertragspartners und aus Gründen der Beweissicherung generell schriftlich oder in Textform zu erfolgen. Der Rücktritt wird wirksam an dem Tag, an dem dieser beim BTV eingeht. Maßgebend ist der Email-Eingang.
5.2 Erfolgt ein Rücktritt nach Campbeginn, so besteht kein Anspruch auf Ersatz der Gebühren.
5.3 Im Falle eines Rücktritts bzw. des Nichterscheinens des zum Camp aus Gründen, welche der BTV nicht zu vertreten hat, kann der BTV angemessenen Ersatz für die Campvorbereitung und für die Aufwendungen des Verbandes verlangen. Bei der Errechnung des Ersatzes sind gewöhnlich ersparte Aufwendungen und die gewöhnlich mögliche anderweitige Verwendung des Campplatzes zu berücksichtigen. Die Rücktrittsgebühren werden nach folgendem Schlüssel berechnet:
Bei Absage 29 bis 56 Tage vor Campbeginn 25% der Gebühren
8 bis 28 Tage vor Camp-Beginn 50% der Gebühren
1 bis 7 Tage vor Camp-Beginn 70% der Gebühren
Bei Rücktritt am Tag des Campbeginns oder bei Nichterscheinen ohne Absage ist der volle Betrag fällig.
Dem Teilnehmer steht es jedoch in jedem Fall frei nachzuweisen, dass dem BTV kein oder nur ein wesentlich niedrigerer Schaden entstanden ist.
5.4 Um das finanzielle Risiko für die Teilnehmer im Falle eines Rücktritts bei Camps des BTV möglichst gering zu halten, empfiehlt der BTV den Abschluss einer Reiserücktrittskosten bzw. Reiseabbruchversicherung.
6. Absage durch den BTV, Ausschluss vom Lehrgang
6.1 Der BTV kann Camps ohne Einhaltung einer Frist absagen, zeitlich verschieben oder an einen anderen Ort verlegen, wenn
6.1.1 schlechte Wetter- oder Witterungsverhältnisse die Durchführung im Interesse der Teilnehmer unter Berücksichtigung der fachlichen Zielsetzung nicht erlauben,
6.1.2 die Durchführung des Lehrgangs für den BTV nach Ausschöpfung aller Möglichkeiten deshalb nicht zumutbar ist, weil die im Falle der Durchführung entstehenden Kosten eine Überschreitung der wirtschaftlichen Obergrenze, bezogen auf das Camp, bedeuten würden. Es gilt generell eine Mindestteilnehmerzahl von 10 Personen. Über eine Mindestteilnehmerzahl informiert die Ausschreibung.
6.2 Im Falle der Absage durch den BTV werden den Teilnehmern die bereits geleisteten Gebühren in vollem Umfang zurückerstattet.
6.3 Der BTV kann den Teilnehmer von der Teilnahme an dem Camp ausschließen, sofern dafür ein wichtiger Grund in der Person des Teilnehmers gegeben ist und dem BTV die Teilnahme des jeweiligen Teilnehmers nicht zumutbar ist. Eine Teilnahme ist dem BTV insbesondere dann nicht zumutbar, wenn der Teilnehmer die Durchführung des Camps erheblich stört oder Anordnungen der Campleitung nicht befolgt. Über den Ausschluss entscheidet die Campleitung. In diesen Fällen findet keine Rückerstattung bereits gezahlter Leistungen statt.
7. Haftungsausschluss
Jeder Teilnehmer nimmt auf eigenes Risiko am Camp teil. Der BTV haftet nicht für Unfälle, die in unmittelbarem Zusammenhang mit dem Camp bzw. dessen Durchführung stehen, soweit sie nicht vom BTV oder seinen Leistungsträgern verschuldet sind. Weiterhin haftet der BTV nur für die ordnungsgemäße Durchführung des Camps.
Für Schäden aus der Verletzung des Lebens, des Körpers oder der Gesundheit haftet der BTV unbeschränkt, soweit diese auf einem vorsätzlichen oder fahrlässigen Verhalten (Tun oder Unterlassen) ihrer gesetzlichen Vertreter oder Erfüllungsgehilfen beruhen Für sonstige Schäden haftet der BTV unbeschränkt, soweit diese auf einem vorsätzlichen oder grob fahrlässigen Verhalten (Tun oder Unterlassen) ihrer gesetzlichen Vertreter oder Erfüllungsgehilfen beruhen.
Eine weitergehende Haftung des BTV findet nicht statt. Soweit die Haftung des BTV ausgeschlossen oder beschränkt ist, gilt dies auch für ihre gesetzlichen Vertreter und Erfüllungsgehilfen. In jedem Fall ist die Haftung des BTV auf den zweifachen Campbetrag begrenzt.
Für ausreichenden Versicherungsschutz ist jeder Campteilnehmer/dessen Erziehungsberechtigte selbst verantwortlich.
8. Leistungs-/Preisänderungen
Änderungen und Abweichungen einzelner Leistungen hinsichtlich des Camps von dem vereinbarten Inhalt, die nach Vertragsschluss notwendig waren und die vom BTV nicht wider Treu und Glauben herbeigeführt wurden, sind gestattet, soweit die Änderungen oder Abweichungen nicht erheblich sind. Der BTV ist insbesondere berechtigt, nach billigem Ermessen die Durchführung des Camps auch anderen Verantwortlichen als den in der Ausschreibung namentlich benannten Verantwortlichen zu übertragen.
9. Unwirksamkeit einzelner Bestimmungen
Die Unwirksamkeit oder Undurchführbarkeit einzelner Bestimmungen des Vertrages hat nicht die Unwirksamkeit des gesamten Lehrgangsvertrages zur Folge.
10. Gerichtsstand
Gerichtsstand ist Nürnberg.

1. scope and organizer
1.1 The following terms and conditions of participation apply to the event BTV JUGEND-CAMP ROTHENBURG ZUM SWIM AND RUN (hereinafter referred to as "event").
1.2 The organizer of the respective event is Bayerischer Triathlon Verband e.V. (hereinafter referred to as "organizer", "we" or "us").
1.3 The Terms and Conditions of Participation apply in the version valid at the time of registration and form part of the contract between the Organizer and the participants.
2. Registration, conclusion of contract, participation fees and services
2.1 The subject matter of the contract is the organization of the respective event in accordance with the published announcement.
2.2 Registration shall take place exclusively via the officially advertised registration systems up to the respective stated registration deadline and only as long as the maximum number of participants has not been reached.
2.3 The contract shall come into effect upon receipt of the registration confirmation by email.
2.4 If the maximum number of participants is reached before the registration deadline, the registration shall be closed prematurely. There is no entitlement to participation.
2.5 All information relevant to the event will be sent by email to the address provided during registration in good time before the event.
2.6 Registrations by minors or persons with limited legal capacity may only be made by their legal representatives. A consent and release from liability signed by the legal representative must be submitted before the start of the event. Participation or collection of event documents is only possible in the presence of a legal representative or upon presentation of a corresponding power of attorney.
2.7 The participation fee shown on the registration form shall apply. This fee and fees for additional services must be paid immediately after registration by SEPA direct debit or credit card.
2.8 Withdrawal by the participant - for whatever reason - or a no-show shall not entitle the participant to a refund of the participation fee or other fees. The same applies in the event of exclusion or disqualification.
2.9 Transfer of registration to third parties is excluded, unless otherwise stipulated in the invitation to tender. The collection of event documents by third parties is only possible with written authorization and presentation of the registration confirmation.
2.10 Cancellation of the event (force majeure): If the event cannot be held for reasons of force majeure or official order for which the organizer is not responsible (e.g. severe weather, natural disasters, pandemics, terror, war), the starting or participation place can be transferred to a subsequent event, provided there is capacity. Alternatively, the participation fee will be refunded, but not the stated organizational and preparation costs.
2.11 Cancellation or modification of the event: If the event is canceled prematurely for the reasons stated in 2.10 or its implementation is changed (e.g. change of route, schedule adjustment, format change), there is no entitlement to a refund or compensation.
2.12 If the number of participants has to be reduced for official or safety-related reasons, admission will be granted according to the time of receipt of the registration. Affected participants will be informed immediately.
3. Eligibility, rules and health requirements
3.1 Any person who meets the requirements specified in the announcement (e.g. minimum age, qualifications) and is not subject to a participation or starting ban is eligible to participate.
3.2 By registering, the participant acknowledges the applicable event rules, implementation regulations and any relevant association or sports regulations, insofar as these are stated in the invitation to tender.
3.3 Participation is strictly personal. Passing on start numbers, participant IDs or access data will result in exclusion and possibly further sanctions.
3.4 The participant declares that he/she is in good health to take part in the event. In the event of health risks or signs of indisposition, participation must be refrained from or participation must be discontinued immediately.
3.5 In the event of known illnesses or health restrictions that require special medical care, participation is at the participant's own risk, unless expressly prohibited by the organizer in advance.
3.6 The participant is responsible for the proper, functional and safe condition of the equipment, materials or aids used.
3.7 Where provided, start numbers, participant identification or proof of access must be worn or used visibly, unchanged and in accordance with the event rules. Participation or classification may be excluded without valid identification.
3.8 Shortening routes, using unauthorized aids, unauthorized support from third parties and violations of applicable fair play, anti-doping or participation regulations are prohibited and will result in disqualification.
3.9 The instructions of the organizer, its employees and any auxiliary persons employed must be followed at all times.
3.10 On public traffic areas, the relevant legal regulations, in particular the Road Traffic Regulations (StVO), shall apply - irrespective of route safety or permits.
4. Disqualification and ban on participation
4.1 Violations of these Conditions of Participation, of event rules or of the organizer's instructions may result in exclusion or disqualification, in particular in the following cases
- unsportsmanlike or grossly disorderly conduct
- violations of rules or participation
- doping or manipulation violations
- unauthorized assistance
- passing on or manipulation of start numbers or participation entitlements
- shortening or unauthorized alteration of the route
- disregard of the organizer's instructions
4.2 The organizer is entitled to impose a temporary or permanent ban on participation in future events in the event of serious or repeated violations.
4.3 Results and rankings will be published. Objections must be made in text form within 24 hours of publication.
5. Image and sound recordings
5.1 Photographs, videos and sound recordings will be made as part of the event.
5.2 The participant agrees that these recordings may be used for editorial, documentary and commercial purposes without restriction in terms of time, space and content.
5.3 The legal basis is Art. 6 para. 1 lit. f GDPR. In the case of minors, the consent of the legal representative is required.
6. Liability
6.1 The organizer is liable without limitation for intent and gross negligence as well as for injury to life, body or health.
6.2 In the event of a slightly negligent breach of essential contractual obligations, liability is limited to the foreseeable damage typical for the contract.
6.3 No liability is assumed for items, equipment or valuables brought along, unless there is intent or gross negligence.
7. Right of withdrawal
A right of withdrawal does not exist in accordance with § 312g para. 2 no. 9 BGB.
8. Data protection
8.1 The processing of personal data is carried out for the execution of the contract in accordance with Art. 6 para. 1 lit. b GDPR.
8.2 Result lists and participant lists may - if relevant for the event - contain and be published in particular surname, first name, year of birth, gender, club/team, start number, placings or results.
8.3 Contact details will only be passed on to third parties with express consent.

9. Final provisions
9.1 The law of the Federal Republic of Germany shall apply.
9.2 Should individual provisions be or become invalid, the validity of the remaining provisions shall remain unaffected.
