1.) Die Teilnahme erfolgt auf eigenes Risiko und ist nur Personen ab 14 Jahren gestattet. Die Strecke wird zum Großteil auf Straßen und Forststraßen mit öffentlichem Verkehr geführt. Dies gilt insbesondere auch auf den ausgewiesenen Zeitmessstrecken (Stages), wo ebenfalls jederzeit mit anderen Verkehrsteilnehmern sowie Fußgängern bzw. Wanderern gerechnet werden muss.
2.) Die Bestimmungen der Straßenverkehrsordnung sind einzuhalten, ebenso die Bestimmungen hinsichtlich der Ausrüstung und der technischen Beschaffenheit von Fahrrädern. Auf der gesamten Strecke ist das Tragen eines Fahrradhelmes verpflichtend.
3.) Streckeninformation: Die Strecke verläuft ausschließlich auf öffentlichen Straßen und öffentlichen Mountainbike-Routen und ist nicht gesperrt, zusätzlich abgesichert oder gesondert beschildert. Aktuelle Informationen rund um das Streckennetz und Streckensperren stellt der TVB Ybbstaler Alpen auf seiner Homepage (www.ybbstaler-alpen.at) zur Verfügung. Das Befahren der Forststraßen ist ausdrücklich nur zu den erlaubten Zeiten gestattet. Fahrer, die gegen die erlaubten Befahrungszeiten verstoßen oder die vorgegebenen MTB-Routen verlassen, können von den Organen der ÖBF AG angehalten werden. Wir behalten uns in diesen Fällen einen Ausschluss von der Spitzhiatl-Individuell-Wertung vor.
4.) Haftungsausschluss: Der RC Naturfreunde Hollenstein stellt im Zeitraum von 1. Juli bis voraussichtlich 31. Oktober die Kontrollpunkte und Zeitmessung zur Verfügung, übernimmt aber keinerlei Haftung für Unfälle oder Schäden, die während der Teilnahme entstehen.
5.) Teilnahmeberechtigung: Die Nennung ist erst gültig, sobald das Startgeld vollständig eingelangt ist. Die zugeteilte Startnummer ist nur in der gewählten Wertungsklasse (MTB oder eMTB) gültig. Mit dieser Startnummer kann der Teilnehmer in der jeweiligen Wertungsklasse beliebig oft starten (Aufpreis € 5 pro weiteren Versuch), jedoch pro Tag nur einmal. Eine Weitergabe bzw. Übertragung der Startnummer an andere Personen ist nicht gestattet und führt zur Annullierung der Ergebnisse und zur Deaktivierung für die Zeitmessung.
6.) Urheberrecht: Jeder Teilnehmer stimmt zu, dass Fotos, Filmaufnahmen, die Teilnehmer zeigen, sowie Interviews mit Teilnehmern von Printmedien, Rundfunk, Fernsehen und jeglichen anderen Medien sowie zu Werbezwecken ohne Vergütungsanspruch und zeitlich unbegrenzt verwendet werden dürfen.
7.) Versicherungsschutz: Den Teilnehmern wird der Abschluss einer Haftpflichtversicherung sowie einer Unfallversicherung, die auch das Risiko der Teilnahme an einem Radrennen beinhaltet, empfohlen.
8.) Einschränkungen der Teilnahme: Bei einem vorzeitigen Ende des Spitzhiatl Individuell bzw. einem temporären Ausfall der Zeitmessung oder bei Streckensperren wegen Holz- oder Bauarbeiten oder in Folge von Unwetterschäden, haben die Teilnehmer keinen Anspruch auf Rückerstattung des Nenngeldes und auch nicht auf Ersatz sonstiger Aufwendungen wie Anreise oder Übernachtungskosten.
9.) Datenschutz: Jeder Teilnehmer ist mit Abschluss seiner Anmeldung mit den aktuellen Datenschutzbestimmung des RC Naturfreunde Hollenstein einverstanden. Diese sind auf der Naturfreunde-Homepage öffentlich zugänglich.
10.) Regelverstöße: Um Regelverstößen vorzubeugen, behält sich der RC Naturfreunde Hollenstein die Möglichkeit vor, an verschiedenen Kontrollpunkten oder Stages Kameras anzubringen, welche die Teilnehmer bzw. die Fahrräder bildlich festhalten. Sollte der Verdacht bestehen, dass beispielsweise jemand in der Kategorie MTB mit einem eMTB teilgenommen hat, kann zur Beweisführung das Foto herangezogen werden.
11.) Sicherheitsbestimmungen in Bezug auf die Covid-19 Pandemie: Die geltenden Sicherheitsbestimmungen (Abstandsregeln, Gruppengrößen, Aufenthalt in Gastronomiebetrieben) sind ausnahmslos einzuhalten.
1. scope and organizer
1.1 The following terms and conditions of participation apply to the event Spitzhiatl Individuell – MTB-Marathon in den Ybbstaler Alpen (hereinafter referred to as "event").
1.2 The organizer of the respective event is Naturfreunde Hollenstein (hereinafter referred to as "organizer", "we" or "us").
1.3 The Terms and Conditions of Participation apply in the version valid at the time of registration and form part of the contract between the Organizer and the participants.
2. Registration, conclusion of contract, participation fees and services
2.1 The subject matter of the contract is the organization of the respective event in accordance with the published announcement.
2.2 Registration shall take place exclusively via the officially advertised registration systems up to the respective stated registration deadline and only as long as the maximum number of participants has not been reached.
2.3 The contract shall come into effect upon receipt of the registration confirmation by email.
2.4 If the maximum number of participants is reached before the registration deadline, the registration shall be closed prematurely. There is no entitlement to participation.
2.5 All information relevant to the event will be sent by email to the address provided during registration in good time before the event.
2.6 Registrations by minors or persons with limited legal capacity may only be made by their legal representatives. A consent and release from liability signed by the legal representative must be submitted before the start of the event. Participation or collection of event documents is only possible in the presence of a legal representative or upon presentation of a corresponding power of attorney.
2.7 The participation fee shown on the registration form shall apply. This fee and fees for additional services must be paid immediately after registration by SEPA direct debit or credit card.
2.8 Withdrawal by the participant - for whatever reason - or a no-show shall not entitle the participant to a refund of the participation fee or other fees. The same applies in the event of exclusion or disqualification.
2.9 Transfer of registration to third parties is excluded, unless otherwise stipulated in the invitation to tender. The collection of event documents by third parties is only possible with written authorization and presentation of the registration confirmation.
2.10 Cancellation of the event (force majeure): If the event cannot be held for reasons of force majeure or official order for which the organizer is not responsible (e.g. severe weather, natural disasters, pandemics, terror, war), the starting or participation place can be transferred to a subsequent event, provided there is capacity. Alternatively, the participation fee will be refunded, but not the stated organizational and preparation costs.
2.11 Cancellation or modification of the event: If the event is canceled prematurely for the reasons stated in 2.10 or its implementation is changed (e.g. change of route, schedule adjustment, format change), there is no entitlement to a refund or compensation.
2.12 If the number of participants has to be reduced for official or safety-related reasons, admission will be granted according to the time of receipt of the registration. Affected participants will be informed immediately.
3. Eligibility, rules and health requirements
3.1 Any person who meets the requirements specified in the announcement (e.g. minimum age, qualifications) and is not subject to a participation or starting ban is eligible to participate.
3.2 By registering, the participant acknowledges the applicable event rules, implementation regulations and any relevant association or sports regulations, insofar as these are stated in the invitation to tender.
3.3 Participation is strictly personal. Passing on start numbers, participant IDs or access data will result in exclusion and possibly further sanctions.
3.4 The participant declares that he/she is in good health to take part in the event. In the event of health risks or signs of indisposition, participation must be refrained from or participation must be discontinued immediately.
3.5 In the event of known illnesses or health restrictions that require special medical care, participation is at the participant's own risk, unless expressly prohibited by the organizer in advance.
3.6 The participant is responsible for the proper, functional and safe condition of the equipment, materials or aids used.
3.7 Where provided, start numbers, participant identification or proof of access must be worn or used visibly, unchanged and in accordance with the event rules. Participation or classification may be excluded without valid identification.
3.8 Shortening routes, using unauthorized aids, unauthorized support from third parties and violations of applicable fair play, anti-doping or participation regulations are prohibited and will result in disqualification.
3.9 The instructions of the organizer, its employees and any auxiliary persons employed must be followed at all times.
3.10 On public traffic areas, the relevant legal regulations, in particular the Road Traffic Regulations (StVO), shall apply - irrespective of route safety or permits.
4. Disqualification and ban on participation
4.1 Violations of these Conditions of Participation, of event rules or of the organizer's instructions may result in exclusion or disqualification, in particular in the following cases
- unsportsmanlike or grossly disorderly conduct
- violations of rules or participation
- doping or manipulation violations
- unauthorized assistance
- passing on or manipulation of start numbers or participation entitlements
- shortening or unauthorized alteration of the route
- disregard of the organizer's instructions
4.2 The organizer is entitled to impose a temporary or permanent ban on participation in future events in the event of serious or repeated violations.
4.3 Results and rankings will be published. Objections must be made in text form within 24 hours of publication.
5. Image and sound recordings
5.1 Photographs, videos and sound recordings will be made as part of the event.
5.2 The participant agrees that these recordings may be used for editorial, documentary and commercial purposes without restriction in terms of time, space and content.
5.3 The legal basis is Art. 6 para. 1 lit. f GDPR. In the case of minors, the consent of the legal representative is required.
6. Liability
6.1 The organizer is liable without limitation for intent and gross negligence as well as for injury to life, body or health.
6.2 In the event of a slightly negligent breach of essential contractual obligations, liability is limited to the foreseeable damage typical for the contract.
6.3 No liability is assumed for items, equipment or valuables brought along, unless there is intent or gross negligence.
7. Right of withdrawal
A right of withdrawal does not exist in accordance with § 312g para. 2 no. 9 BGB.
8. Data protection
8.1 The processing of personal data is carried out for the execution of the contract in accordance with Art. 6 para. 1 lit. b GDPR.
8.2 Result lists and participant lists may - if relevant for the event - contain and be published in particular surname, first name, year of birth, gender, club/team, start number, placings or results.
8.3 Contact details will only be passed on to third parties with express consent.

9. Final provisions
9.1 The law of the Federal Republic of Germany shall apply.
9.2 Should individual provisions be or become invalid, the validity of the remaining provisions shall remain unaffected.
