1. Scope and Organizer
1.1 The following terms and conditions apply to the event 10. Wuggi-Triathlon (hereinafter referred to as the “Event”).
1.2 The organizer of the respective event is Bayronman e.V. (hereinafter referred to as the “Organizer”, “we” or “us”).
1.3 The terms and conditions apply in the version valid at the time of registration and form part of the contract between the Organizer and the participants. They supplement the rules and information resulting from the respective event announcement.
2. Registration, Conclusion of Contract, Participation Fees and Services
2.1 The subject of the contract is the execution of the respective event in accordance with the published announcement.
2.2 Registration takes place exclusively online via the website https://spoferan.com/en/events/wuggitriathlon until the stated registration deadline and only as long as the maximum number of participants has not been reached.
2.3 The contract is concluded upon receipt of the registration confirmation by email.
2.4 If the maximum number of participants is reached before the deadline, registration will be closed early. There is no entitlement to participate.
2.5 All event-related information will be sent in good time before the event by email to the address provided during registration.
2.6 Registrations of minors or persons with limited legal capacity are only permitted through their legal representatives. A declaration of consent and liability waiver signed by the legal representative must be submitted before the event. Bib pickup is only possible in the presence of a legal representative or with written authorization.
2.7 The participation fee stated at registration applies. This and fees for additional services must be paid immediately after registration by SEPA direct debit or credit card.
2.8 Withdrawal by the participant – for whatever reason – as well as non-appearance (no-show) does not entitle the participant to a refund of the participation fee or other charges. The same applies in case of exclusion or disqualification.
2.9 A transfer of the registration to third parties is excluded. The right to participate is a personal, non-transferable right of the registered athlete. Unless the announcement explicitly states otherwise, cancellation, distance changes or late registrations are generally not possible.
2.10 Bib pickup must generally be done in person upon presentation of the required documents (registration confirmation, race license, etc.). Pickup by third parties is only permitted with written authorization and presentation of the registration confirmation.
2.11 Cancellation of the event (force majeure): If the event cannot be held due to force majeure or official orders beyond the Organizer’s control (e.g. severe weather, pandemics, terrorism, war), the entry may be transferred to a follow-up event if capacity allows. Alternatively, the participation fee will be refunded, excluding organizational and preparation costs.
2.12 Interruption or modification of the event: If the event is interrupted early or changed for the reasons stated in 2.11, there is no entitlement to a refund or damages.
2.13 If the number of participants must be reduced for official or safety reasons, admission is based on the chronological order of registrations. Affected participants who cannot start will be informed immediately. There is no entitlement to refund or damages in accordance with section 2.12.
3. Eligibility, Rules and Health Requirements
3.1 Eligible to participate is any person who fulfills the requirements stated in the announcement (e.g. minimum age) and is not subject to a ban.
3.2 By registering, the participant acknowledges the valid competition and association rules of the DTU (German Triathlon Union), available at: https://www.triathlondeutschland.de/service/downloads
3.3 Participation is strictly personal. Passing on the bib number leads to exclusion and possibly further sanctions.
3.4 The participant declares to be physically fit to take part. In case of health risks or discomfort, participation must be avoided or the race must be stopped. The participant is aware that participation involves dangers and risks of serious injury up to fatal accidents and property damage. Participation is at the participant’s own responsibility and risk. The Organizer assumes no liability for health risks arising from participation. Section 6 remains unaffected.
3.5 In the case of known chronic illnesses requiring special medical care, participation is excluded unless prior written approval of the Organizer is obtained.
3.6 The participant is responsible for the proper and safe condition of the equipment used.
3.7 The bib number must be worn visibly, unchanged and according to the competition rules. Without a bib number, no timing or ranking will be provided.
3.8 Cutting the course, unauthorized aids, accompaniment by third parties and violations of anti-doping rules are prohibited and lead to disqualification. The participant commits to comply with all regulations issued in the announcement.
3.9 Instructions from the Organizer, its staff and helpers must be followed at all times.
3.10 On all traffic areas, the German Road Traffic Regulations (StVO) apply despite course security.
4. Disqualification and Start Ban
4.1 In the event of violations of the terms, competition rules or instructions, exclusion or disqualification may occur, in particular in cases of:
- unsportsmanlike conduct
- rule violations
- doping violations
- unauthorized assistance
- manipulation or transfer of the bib number
- shortening the course
- ignoring instructions
4.2 In serious cases, the Organizer may impose a ban for future events.
5. Image and Audio Recordings
5.1 Photo, video and audio recordings will be made during the event. Due to the size of the event, it is not possible to remove individual persons from the material.
5.2 By registering, the participant grants the Organizer a simple, irrevocable, unlimited and transferable right of use for recordings created in connection with the event.
5.3 Legal basis is Art. 6 para. 1 lit. f GDPR. For minors, consent of the legal representative is required.
6. Liability
6.1 The Organizer’s liability is limited to intent and gross negligence. This does not apply to damages resulting from injury to life, body or health.
6.2 In the event of negligent breach of essential contractual obligations, liability is limited to the foreseeable, typical damage.
6.3 The participant is responsible for personal belongings and equipment brought along.
6.4 The participant is aware that vehicles and/or pedestrians may be present on the course and that traffic regulations must be observed.
7. Right of Withdrawal
A right of withdrawal does not exist pursuant to § 312g para. 2 no. 9 BGB.
8. Data Protection
